1. Services to be provided
1.1 Asten Beauty Pte Ltd. (UEN: 201231026M) (“Asten Beauty”) provides services such as face threading, facial treatment, eyebrow embroidery, eyelash
extensions, ear candling etc. (“Services”) in accordance with the Terms and Conditions herein.
1.2 The customer’s (“Customer”) utilisation of the services rendered by Asten Beauty Pte Ltd constitute the Customer’s acceptance and agreement to be bound by the Terms and Conditions herein.
1.3 Asten Beauty may from time to time and at its sole discretion amend the Terms and Conditions without prior notice, and the Customer’s continued use of Asten Beauty’s Services shall constitute the Customer’s acceptance and agreement to be bound by the amended Terms and Conditions. For the avoidance of doubt, reference to the “Terms and Conditions” shall include the Terms and Conditions as may be amended from time to time.
2. Package terms
2.1 Save as set out in clause 2.1.3 below, all packages for any Services sold to the Customer are strictly non-refundable and any unused credits / sessions will expire 1 calendar year from the date of the purchase of the said package (“1 Year Period”).
2.1.1 Credits / sessions within a package are transferable to family members upon the request of the Customer, t subject to the approval of Asten Beauty at its sole discretion. For the avoidance of doubt, utilisation of the Services by the said family member shall constitute acceptance and agreement by said family member to the Terms and Conditions herein and reference to Customer shall where appropriate, include such person(s) to whom the credits / sessions are transferred to by the original Customer.
2.1.2 Subject to approval of Asten Beauty at its sole discretion, Customer may elect to transfer any unused credits in an existing package to a new package. For the avoidance of doubt, Asten Beauty will not provide any monetary refund for any unused credits that are not transferred to a new package within the 1 Year Period.
2.1.3 In the event the Customer has a medical condition that prevents him/her from utilising Asten Beauty’s services, Asten Beauty may at their sole discretion agree to refund any unused credits to the Customer. Such requests for a refund shall be accompanied by a medical report from a licenced medical practitioner in Singapore specifying that the Customer is unable to utilise the package purchased from Asten Beauty due to his/her medical condition. No requests for a refund after the 1 Year Period shall be entertained.
3. Acknowledgement, Warranties and Undertakings
3.1 In consideration of the Services provided by Asten Beauty, the Customer warrants and undertakes that Customer is in a good physical condition, and has no disabilities, impairments or ailments that would prevent him / her from receiving the Services provided by Asten Beauty.
3.1.1 If in doubt, the Customer should consult their own doctors before proceeding with any Services provided by Asten Beauty. At all times, the Customer is responsible for ensuring that he/she is fit to proceed with the Services to be provided by Asten Beauty.
3.1.2 By electing to proceed with any Services provided by Asten Beauty, the Customer acknowledges and accepts that there is an inherent risk of adverse
side effects with all beauty treatments, and that the reaction of the Customer’s body to the Services provided may be such as to result in adverse side effects that are not within Asten Beauty’s control or contemplation. The Customer acknowledges and agrees to assume sole responsibility for any such adverse side effects where such adverse side effects are not due to Asten Beauty’s negligence and shall not hold Asten Beauty responsible for any such injury suffered by the Customer thereby.
3.2 Asten Beauty may at its sole discretion decline to provide Services, or decline to continue with the provision of Services, in the event that it determines that the Customer is not suitable to receive such Services for any reason whatsoever.
3.3 The Customer acknowledges that the results of the Services provided to each person will vary and that Asten Beauty does not guarantee the desired outcome of the Services provided to each Customer.
3.4 The Customer acknowledges and accepts that he/she is responsible for the safekeeping of any and all personal belongings brought into Asten Beauty’s premises.
3.5 Asten Beauty shall not be responsible or liable for:
3.5.1 the death of, or injury to, the Customer or any other person, to the fullest extent permissible by applicable laws and regulations;
3.5.2 injury, loss or damage suffered by the Customer or any other person owing to the Customer’s failure to adhere to the instructions provided by Asten Beauty or its employees or agents, during the provision of the Services or otherwise;
3.5.3 any theft, damage, destruction or loss of property of the Customer or any accompanying guest of the Customer including but not limited to money, jewellery, documents and clothing; or
3.5.4 any loss or damage suffered by the Customer or any other guest of the Customer as a result of any cause beyond Asten Beauty’s control.
3.6 Save where death or personal injury is caused by Asten Beauty’s negligence, the Customer agrees to release, discharge and hold harmless Asten Beauty and its employees and agents, from all claims or demands whatsoever, on account of any injury or accident arising from the Services provided by Asten Beauty.
3.7 Under no circumstances shall Asten Beauty be liable to the Customer (regardless of the basis of the liability including without limitation as a result of breach of contract, negligence or any other tort, under statute or otherwise) for loss of earnings, loss of anticipated savings, and any indirect or consequential or incidental or special loss or damages.
4. Indemnity
4.1 The Customer shall indemnify and keep Asten Beauty indemnified against all actions, demands, proceedings, claims, liabilities, damages, losses, costs, charges and/or expenses of any nature whatsoever, made against or suffered or incurred by Asten Beauty (including those relating to death or injury to persons or loss or damage to property) arising directly or indirectly out of or in connection with:
4.1.1 Any act, default, omission or negligence of the Customer;
4.1.2 Any breach or non-observance by the Customer of these Terms and Conditions; and
4.1.3 Any conduct of the Customer or his/her accompanying guests at the premises of Asten Beauty.
5. Governing Law and Jurisdiction
5.1 This Service Agreement and these Terms and Conditions shall be governed by and construed in accordance with Singapore law.
5.2 Asten Beauty and the Customer each agree that any dispute or claim arising out of or in connection with the Services provided by Asten Beauty and/or these Terms and Conditions, shall be referred to the Singapore Courts and parties agree to the exclusive jurisdiction of the Singapore Courts.
